CARRIER RULES AND PRICES
Addendum/*CRA (Carrier rules apply)


We all try to avoid any problems but due to nature of trucking, Industry standards, new ELD mandate in effect, and in order to be fair, stay in business and better serve you, we are listing our company policy prices and fees.


These terms apply to and supersede all signed agreements, rate confirmations and truck order agreements:

ABSOLUTELY no changes/rate reductions to any agreements will be allowed after it was signed, without consent from 1389 Company. If when load is booked, agreement signed and/or truck is dispatched an additional charge to your bill will occur for unexpected change of pickup/delivery times, weight of freight and pickup/delivery addresses. Layover fees or detention rules and will be applied to freight bill depending on those changes. Broker/shipper is responsible for providing at his own expense and in a reasonable time (up to 2 hours) a secondary delivery location upon carrier’s request. If that location is more than 30 miles in excess of miles in booked rate confirmation the standard charge of $2 per mile will be applied. Carrier is not responsible for any freight/pallet count unless driver load count service was preselected, and for any loading damages to freight made by the shipper. Carrier is not responsible in any way for any acts of nature, acts of God or any costs, delays, any damages or fees due to unpredictable truck or trailer repairs or any safety operation issues.

PRICING

Wrong address or driving out of route for more than 5 miles will be charged $30 or $3 a mile whichever is greater. Carrier will never under any circumstances be responsible for lumper, loading/unloading charges, we will forward you the bill for any charges that occur plus $10 check processing fees.

Attention:

In very rare occasions, we as a common sense carrier allow flexible arrival time even with strict appointments due to safety and nature of trucking.

Common courtesy of accepting a driver who is up to 30 minutes late is required due to unexpected reasons such as: Safety issues, ELD rules, train blocking the road etc...

Common courtesy of up to 3 hours late driver arrival is required if arrived after scheduled appointment time due to unavoidable circumstances such as: bad accident delays, heavy road closure, mandatory DOT roadside inspection, etc...

In all those rare and unexpected cases detention time will be counted same as FCFS but with a difference of a 4 hour mark instead of 3 hour mark (described below). If unable to comply to these reasonable loading/unloading times a standard Layover per day will be added to your bill.

DETENTION TIME

Detention charge is $40.00/hour paid in 15 minute increments and will be rounded up to the nearest number. The Detention time starts 2 hours from set appointment. FCFS loading/unloading will be free of charge for up to 3 hours. If the 3 hour mark is crossed there will be a retroactive charge of a 1 hour detention (example: 2h: 59m is free but 3h+ is $40.00 for the previous hour + detention time past the 3rd hour mark if it occurs). Loading/unloading and detention clock starts 10 minutes from the arrival of our truck at the company address and not from an actual check in time because often times slow check in process is due to poor shipper/receiver management (examples: long line of trucks due to poor scheduling, office personnel too slow, no respect for other humans, etc.) Exception to this rule is when truck arrives before scheduled arrival time. If detention time is more than 8 hours then standard Layover fee for the day occurs. If the written times on the bills are not correct or shipper/receiver refuses to sign correct times for any reason, then company driver will put correct times and sign them himself. If this occurs, driver signature supersedes all other signatures. This is simply because of the fact that the driver is the one who is most aware about loading times and who is the most knowledgeable person about the actual loading and delivery times.

LAYOVER

Occurs at rate of $400 per day Sunday to Thursday, and at a rate of $500 per day Friday and Saturday. LAYOVER limit is 2 days, Storage fee applies afterwards.

TONU
(Truck Order Not Used)

$200+ fuel expenses of $0.50cpm for all empty driven miles if any. TONU will be charged for all loads and for any reason if the load is canceled by the broker or shipper if a confirmation agreement is already agreed and signed!

TRUCK/TRAILER WASHOUT FEE

If hauling your load results in excessive left over dirt a cleaning fee of $100 or more will be applied to your bill. We provide clean food grade trailers for pickups. Please understand that it takes time and money to find trailer washout facility, it is often miles away and it takes forever for trailers to fully dry.

Driver Load count - $30-$200
Driver assist - $50-$100
Driver Loading/unloading - $200 per loading/unloading
Check processing fee - $10
Trailer storage fee - $800/day when secondary delivery location was not provided and layover limit passed.

All payments are due upon receipt, If overdue the following increase will be added to all invoices: 30+ days 5% 60+ days 10% and 90+ days 25%

Failure to comply could result in any of the unfortunate: negotiating much higher rates on next loads with your broker firm, going to court, claim against broker bond, bad credit history- going to a collection agency.
